The following are the terms and conditions dealings with us of our website and services and by registering with us and/or making a purchase you are agreeing to be bond by them. We may change these from time to time by updating this page.

1. Orders

No contract shall exist between you and Bindoon Tractors Pty Ltd until Bindoon Tractors Pty Ltd has sent you an e-mail or telephoned you confirming acceptance of your order.
Sizes and designs of goods being ordered should be checked carefully by the customer to ensure they will meet their requirements before an order is placed as Bindoon Tractors Pty Ltd will not be liable to exchange goods that have been ordered incorrectly. Bindoon Tractors Pty Ltd is entitled to withdraw from any contract in case of errors or inaccuracy regarding the goods or the order appearing on the site. Bindoon Tractors Pty Ltd reserves the right to alter prices, colours, designs and specifications at any time should it be necessary to do so.

2. Availability

Due to vast range of colours, designs and sizes of goods offered, we cannot guarantee that goods ordered will be held in stock for immediate delivery. We will endeavour to deliver within 14 days of order whenever possible, but goods which have to be ordered from the factory in the UK will take several weeks to arrive. When you place an order you will be given a more accurate delivery estimate. Delivery estimates are mere estimates and will be subject to delay if payment is not received for the order or artwork for personalised jumps ordered is not forthcoming.

3. Pricing and Payment

All prices are quoted ex-premises in Australian dollars, and are inclusive of GST at the standard Australian rate.

The delivery charge to mainland Australia is 10% of the total order value

Outside of mainland Australia the delivery charge will vary according to order size and delivery location and will be quoted on an individual basis and will be in addition to that quoted on the website.

4. Payment

All prices are in Australian Dollars and subject to the delivery charges noted above. All goods must be paid in full before despatch either by credit card or cheque. Cheques will be accepted but goods will not be dispatched until payment has cleared. Goods remain the property of Bindoon Tractors until paid for in full.

5. Delivery

Delivery dates are given as an estimate. All goods ordered may be collected from Bindoon Tractors premises in WA, please arrange this when placing an order. Alternatively, a nationwide delivery service is available via a national courier. Please not accurate postal codes are required for courier deliveries. All deliveries made via courier must be carefully checked and signed for as Bindoon Tractors cannot be liable for any damages or shortages if goods have been signed for as received in full and in good condition.

6. Returns

You can return any of the goods received to Bindoon Tractors Pty Ltd provided they are unused and in their original condition and packing or packing of similar quality and protection to prevent damage in transit. Any items should be returned within 14 days from the date of dispatch. Bindoon Tractors Pty Ltd does not use a freepost service for returned items. Delivery and insurance for returning items to Jump4Joy will be at the expense of the sender. Bindoon Tractors Pty Ltd will refund or exchange the cost of the goods but is unable to refund the delivery charge for dispatching the goods. Bindoon Tractors Pty Ltd will not be held responsible for items damaged or lost while being returned to the Company. This returns policy does not affect your statutory rights.

8. Intellectual Property Rights

8.1 You acknowledge that Bindoon Tractors Pty Ltd own or are licensed to use all copyright, database rights, trade marks and other intellectual property rights in and to all parts of this web site and the business of Bindoon Tractors Pty Ltd (including the structure design and layout of the web site) and assert all such rights worldwide.
8.2 You are entitled to use our web site in accordance with these terms and conditions. You must obtain Bindoon Tractors Pty Ltd prior written consent before you use the web site or any part of it in any other manner.
8.3 All persons, individual and corporate, are prohibited from providing hypertext or other links to the jump4joy.com.au web site, from their own web site or from a third party's web site, without our prior consent.

9. Liability

9.1 Bindoon Tractors Pty Ltd attempt to ensure that the information available on the web site at any one time is accurate. However we cannot guarantee that it will be fault free.
9.2 Bindoon Tractors Pty Ltd does not accept liability for any errors and admissions and reserves the right to change information, specification and description of listed goods, and products at any time.
9.3 Bindoon Tractors Pty Ltd does not make any warranty that the web site is free from infection by virus or anything else that has contaminating or destructive properties.
9.4 Bindoon Tractors Pty Ltd does not accept liability for any losses or claims arising from any inability to access the web site, or any failure to complete a transaction.
9.5 Bindoon Tractors Pty Ltd does not accept liability for any indirect or consequential loss of any kind in contract, tort or otherwise arising out of use of the web site for any products or services purchased from the web site.
9.6 Bindoon Tractors Pty Ltd, Inc will only be liable for direct loss up to a maximum total of the price of the product purchased in respect of any claim.
9.7 Any equine activity by the very nature of the sport entails an element of risk. Jumping has the potential to increase that risk. Bindoon Tractors Pty Ltd, its owners and agents assume no responsibility whatsoever beyond the total cost of the purchased product. The Purchaser of the product and subsequent users of the product assume all responsibility for the use of the product up to and including any injury and/or death associated with the use of such product(s).
9.8 This liability section applies only to the extent permitted by law.

10. General

10.1 This Agreement does not confer or purport to confer on any third party any benefits or any right to enforce any term of this Agreement.
10.2 Bindoon Tractors Pty Ltd will not be liable for any delay in or failure to perform obligations if that delay or failure is caused by circumstances beyond their control.
10.3 Time shall not be of the essence in the performance of this Agreement.
10.4 If for any reason any provision of these terms and conditions is unenforceable, the validity of the remaining provisions shall not be affected.
10.5 The terms and conditions and contracts between you and Bindoon Tractors Pty Ltd shall be governed by Australian law and all disputes shall be submitted to the jurisdiction of the English courts.
